We start out with the premise that all marital property and liabilities, which are assets and debts accumulated during the marriage, should be equally split between the parties. There are exceptions to this rule which I will discuss depending on the particular case, but generally, the Court will want to see a fair and reasonable split. When keeping this premise in mind, most parties should be able to settle on the distribution of marital assets and debts. There will also be an evaluation to determine Marital vs. Non-Marital assets and debts, valuation dates, and other considerations. I will educate my client on the Equitable Distribution issues and can assist with creative distribution schedules which lead to fair resolutions.
